Acutely Privacy Policy

Acutely ("Acutely," "we," "us," or "our") operates a healthcare marketplace platform at acutely.health that connects patients with independent medical providers for cash-pay, membership-based care ("the Platform" or "the Service"). This Privacy Policy explains what information we collect, how we use it, and the choices you have.
By using Acutely, you agree to the collection and use of information as described in this policy.
1. Information We Collect
Information you provide directly
- Account and identity information: name, date of birth, gender, phone number, email address, and mailing address
- Provider-submitted information (for providers): professional credentials, board certifications, state medical licenses, malpractice insurance documentation, National Provider Identifier (NPI), tax and banking information for payment processing
- Payment information: processed directly by our payment processor, Stripe; Acutely does not store full payment card numbers
- Communications: messages exchanged between patients and providers through the Platform, including any files or documents uploaded to support clinical context
- Agreement records: e-signatures, timestamps, IP address, and general location captured when you sign platform agreements
Information collected automatically
- Device and usage information (browser type, general access times, pages viewed)
- Log data related to security and fraud prevention
2. How We Use Your Information
We use the information we collect to:
- Create and manage patient and provider accounts
- Facilitate the connection between patients and their chosen independent provider
- Verify provider credentials, licensure, and malpractice coverage
- Process membership payments through Stripe
- Send appointment-related notifications, account verification codes (one-time passcodes), and invitation messages via SMS and email
- Maintain records required for compliance, agreement tracking, and dispute resolution
- Improve and maintain the security of the Platform
We do not sell your personal information. We do not share your information with third parties for their own marketing purposes.
3. SMS and Email Communications
If you provide a phone number or email address, Acutely (or your provider through the Acutely platform) may send you:
- One-time passcodes for identity verification
- Invitations to join a provider's membership program
- Account and appointment-related notifications
Consent: By providing your phone number during the invitation and enrollment process, and by signing the Patient Membership Agreement, you consent to receive these messages. Message frequency varies based on your account activity and provider communications. Message and data rates may apply.
Help: Reply HELP to any text message, or contact support@acutely.health, for assistance.
Opt-out: You may reply STOP to any text message at any time to opt out of further SMS communications. You may also contact your provider or support@acutely.health to update your communication preferences.
4. How We Share Information
We share information only as necessary to operate the Platform:
- With your provider: patients' relevant health-adjacent context and communications are shared with their selected provider to facilitate care
- With service providers who process data on our behalf, including:
- Stripe (payment processing)
- Supabase (database and secure file storage)
- Twilio (SMS delivery)
- Resend (email delivery)
- Anthropic (AI-assisted drafting of provider responses, using structured summaries rather than raw clinical files)
- As required by law, or to protect the rights, safety, or property of Acutely, our users, or others
We do not share your information with third parties for advertising or marketing purposes.
5. Data Security
We use industry-standard safeguards to protect your information, including encrypted storage, access-controlled databases, and private, signed-URL file storage for sensitive documents such as malpractice policies. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
6. Your Choices and Rights
You may:
- Request access to, correction of, or deletion of your personal information by contacting support@acutely.health
- Opt out of SMS communications at any time by replying STOP
- Close your account by contacting your provider or Acutely support
7. Data Retention
We retain personal information for as long as your account is active or as needed to comply with legal, regulatory, or contractual obligations, including agreement and compliance records required to be retained on an annual basis.
8. Children's Privacy
Acutely is not directed at individuals under the age of 18, and we do not knowingly collect information from children.
9. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a revised "Last updated" date.

This policy describes Acutely's platform-based services. In-office care provided by your independent provider continues to be governed by that provider's own HIPAA Notice of Privacy Practices and billed through insurance where applicable, separately from your Acutely platform membership.
